The instructor is self employed and bound by a professional code of conduct published and enforced by DVSA. The instructor and the Student will agree all matters relating to the timing, location and duration of individual lessons. The Student must notify the Instructor of any matters which affect their ability or entitlement to having driving tuition, for example, but not limited to, any lack, or loss, of a valid provisional licence, any illness or prescribed drugs which may affect their driving ability.

The instructor will:

• at all times, to the best of their ability, endeavour to teach correct driving skills according to DVSA's recommended syllabus.
• endeavour to be polite and reliable.
• have a car fully insured for driving tuition and fitted with dual controls.
• ring the Student if running more than 15 minutes late.
• have the right to cancel the lesson at short notice due to weather, health or car related issues.
• have the right to withdraw the use of their vehicle for tests if they feel it necessary.
• not tolerate abusive language or behaviour and will terminate the lesson immediately and the Student will be charged for the lesson.
• not tolerate alcohol and/or drugs. If the Instructor suspects that the Student has been drinking alcohol or taking drugs prior to the driving lesson, the lesson will be terminated immediately and the Student will be charged for the lesson.
• not smoke in the car.
• not use the lesson time for any other form of business, personal or otherwise.
• safeguard and account for any monies paid in advance by the Student and will make detailed receipts available on request.

The student will:

• arrive at the lesson on time.
• wear suitable clothing and footwear.
• look out for the Instructor at the arranged time as the Instructor will wait at the agreed pick up point for 15 minutes only.
• pay at the beginning of the lesson, unless otherwise prearranged.
• give 48hrs notice to cancel or postpone a lesson. If this is not possible and the lesson cannot be rearranged to a mutual time within 4 days of the cancelled lesson, the full training fee may be lost or charged.
• give 14 days notice to cancel or change a semi-intensive course. Failure to give this notice could result in loss of the full course fee.
• provide a note from the doctor or hospital if cancelling within 48 hours of a lesson due to ill health and wish to avoid payment of the lesson.
• lose any fees paid if lessons are cancelled within the notice period and fail to make contact with the Instructor within 2 months to rebook.
• not smoke in the car or drive while under the influence of alcohol and/or drugs.

Late Cancellation Policy due to Covid-19

It is acceptable to cancel the lesson with less than 48hrs notice and with no penalty for you or me:

• if you or anyone in your household becomes unwell and/or is showing symptoms.
• if you or I believe we may have been in contact with someone who is unwell and/or is showing symptoms.
• if I or anyone in my household becomes unwell and/or is showing symptoms.

Price Changes

The price of lessons which have not been pre-paid as part of a block booking may be changed at any time.
The Student will always receive prior notice of such changes.
Special offers can be withdrawn at any time and only one offer can be taken per booking. The offer cannot be used in conjunction with any other offer.
Free lessons can only be taken in conjunction with a paid lesson.
Refunds will be at the discretion of the Instructor and may be paid after deducting those hours taken (calculated using the current standard hourly rate).

Test

If the Student has applied for a driving test or the Instructor has applied for a test on behalf of the Student, and the Student does not keep up to date with lessons prior to test, or if in the opinion of the Instructor, the Student is not safe to proceed with the test, the Instructor reserves the right to refuse the use of the tuition vehicle for the test. The Instructor will endeavour to inform the Student of this intention for the test to be rescheduled without loss of test fee. The Instructor will not be liable for loss of the Student's documentation or any loss of test fees if the Student is not successful in passing the eyesight test or the driving test. However, the Instructor will take responsibility for loss of test fees if the test is cancelled due to the condition of the vehicle. No responsibility can be taken for tests cancelled by the DVSA due to adverse weather or any other reason.

Complaints

In the first instance, any complaints should be addressed to the Instructor.
If the Student is not satisfied with the settlement of a dispute, reference may be made to DVSA's Registrar of Approved Driving Instructors:

Privacy Policy

With your permission, GEMS will keep a record of your details and training progress and as part of the General Data Protection Regulations (GDPR), will ensure that all personal details will not be shared with any third parties and your data will remain safe.

The Agreement

GEMS reserves the right at any time to modify this Agreement and to impose new or additional terms or conditions. Such modifications and additional terms and conditions will be effective immediately and incorporated into this Agreement. Your continued use of GEMS will be deemed acceptance thereof.

Please acknowledge as having read and understood the terms and conditions. In addition, declaring that you have not received any driving penalties. A copy is available on request. A signature is not necessarily required.
